Wait. You can trademark the layout of a store?

Apple won a legal victory yesterday when the European Court of Justice ruled it could trademark the layout of its stores, just as it has in the US. But how does that work? The legal standard in question—whether a consumer could reasonably mistake our office for an Apple store—isn’t going to be met. But more importantly, Apple’s US trademark, officially granted last year, is the result of a nearly three-year process of refinement to ensure that it wouldn’t protect functional items (i.e., you can’t trademark tables in your store) and that, altogether, it comprises a unique identity. ‘Learn by Doing’ and Other Lessons From Retail

When Ron Johnson began working in retail, he was entering a startup field. “That’s when Mickey Drexler first went to the Gap from a department store” and when “Les Wexner, of Limited fame and Victoria’s Secret, invented the modern specialty store,” he recalls. “That’s when big box retailing started.” Johnson, who started his career on the loading dock of Mervyn’s, later went on to Target, where his idea for selling a low-priced tea kettle led the discount store to remake itself. In April, he was pushed out of JCPenney after failing to turn it around, but he had plenty of wisdom to share on May 19, when he spoke at a View From the Top event. There, the newly minted founder of the Johnson Partners investment fund revealed what three decades in retail has taught him. In collaboration with USA Today, agency RPA conducted a study that looks at the relationship between brands and their creative agencies. Why Brand Management Will Replace Marketing

Why Brand Management Will Replace Marketing

Why Brand Management Will Replace Marketing

P&G’s decision to formally end the era of “marketing” at the company and make the shift to brand management may accelerate what amounts to much more than a title change for marketers generally. It could point to a fundamental re-examination of the role of the people responsible for brands. While “marketing” and “brand management” are often treated as synonyms, there is an important distinction between the two terms. Marketing focuses on the activities associated with the promotion and distribution of products and services. Brand management has, for many, been historically focused on identity management but is now much more concerned with the active management of the market value and competitive strength of a brand as an (intangible) company asset. Marketing is about spending money. It’s how brands accumulate value. Brand management should focus on how products continue to wrap story and distinction around what they offer to increase competitiveness and build loyalty. The two are linked – but different. Marketing is the means. Brand management should be the goal. QR Codes for the Dead

QR Codes for the Dead

QR Codes for the Dead

QR codes sometimes appear in unlikely places, on everyday objects rather than on advertisements or billboards. And even on weird things like on teabags, the backs of Subway employees’ T-shirts, and even on bananas. When the advertising campaign ends or a company nosedives and disappears, the QR code itself may endure on these materials. Given the proliferation of memorialization websites and the use of social networking profiles as mourning spaces, it may come as no surprise that QR codes now appear on headstones, linking graveyard visitors to online tributes to the dead. QR codes are getting into politics by engaging voters

It is far from rare, nowadays, to see QR codes here and there, including on poster and billboard ads, as well as on bus stops and on food packaging, but now they are being used in an entirely new way for the European Elections this year. A South East standing party in the 2014 elections will have the barcodes added to the ballot paper. This is the first time that QR codes have made it onto the country’s ballot papers. This is because the YOURvoice party has managed to incorporate the barcodes into their official logo. This has never happened before in the U.K., according to the Electoral Commission. It was chosen by the party to be able to give voters the ability to scan using their own smartphones and a free reader app. Source: QR codes are getting into politics by engaging voters – QR Code Press | QR Code Press Rights to all content (text, images, videos etc.) with post source.
